I have been an attorney for over 20 years. I began my legal career in 2001 as a former prosecutor for Jefferson County, Colorado where I took over 50 cases to trial in the 6 1/2 years I was there. I very much enjoyed my time as a deputy DA and it was personally gratifying to know I was helping victims of a crime obtain justice. Short answer, it depends. Minor injury claims are often handled without legal representation while many people with more significant injuries or complicated claims are more inclined to have an attorney handle the case. Car crash cases can be confusing so a free consultation can help you decide if representation makes sense in your specific case. Sometimes what is thought to be a minor injury, does not heal as expected and turns into a bigger deal. That's why you want to be cautious about settling your case early on before you understand the extent of your injuries and know if you will make a full recovery. Again, it depends. A fair assessment of the injury claim's value should factor in the total medical bills, future medical needs (if any), lost wages, pain and suffering and any permanent physical impairment and/or disfigurement. There is no magic formula when it comes to determining the value of car crash injury claims, it is very fact and case specific. An experienced attorney should know how to present your case to the insurance company to maximize your recovery and also look for all possible insurance coverage.
Almost all, if not all, personal injury lawyers in Colorado will offer to handle injury claim representation on a contingency fee basis. That means you don't have to pay a retainer or upfront attorney fees. The attorney will get paid an agreed percentage out of the final outcome. If there is no money obtained for you then no attorney fees are owed. While the percentage can vary from law firm to law firm, from my experience the standard contingency fee is generally between 33% and 40% for most car crash cases. If the case is resolved before a lawsuit, the fee will usually be closer to one-third of the settlement. If the case ends up in litigation the fee is typically closer to the 40% as there is more time and work required with a lawsuit. The contingency fee agreement that you will be asked to sign to retain the lawyer must detail the specific percentage you are agreeing to if your case settles without a lawsuit and if your case requires a lawsuit.
Sadly, this does happen. I always encourage people who call me in this situation to see if they can work things out with their current attorney but sometimes the relationship is broken. If you end up in this situation, you are able to consult with a new attorney about taking over representation of your case. I have heard many horror stories through the years, most recently a woman reached out telling me she was not allowed to talk to her attorney on the phone, only email communication was "allowed" and that she had been through 3-4 paralegals in the last 2 years and several different attorneys and had no idea what was going on with her case. She wanted to know if this was normal. I once took over a case where the prior attorney indicated he believed the client's claim was only worth $20,000 max after the insurance company offered $10,000. He flat out refused to file a lawsuit in the matter and was bullying the client to just settle her case. The client who suffered permanent injuries disagreed with his assessment and hired me to take over representation. We took her case to trial and in the end obtained $3,000,000. Now of course this is an extreme example (and please know prior results do not guarantee a similar outcome. Every case is unique and must be judged on its own merits and facts) but it does go to show it is important to trust your gut as that client was pretty worn down by her prior attorney and almost closed her case out for a tiny fraction of what it was worth, luckily a close friend referred her to me. The retainer agreement you signed should have a paragraph about what happens in this situation. When I take over representation in these situations, I always agree to handle any asserted lien from the prior attorney out of my fees so my client is not put in a worse situation.

Haha, yes we do! As you can see from all the pink, I have chosen to set myself apart from the mainstream personal injury attorneys you see on tv and hear on the radio. I have found during my over 11 years of doing injury work that in general probably over 90% of the cases settle so ending up in litigation is actually pretty rare. Experience is certainly important when shopping for an injury attorney but hiring an attorney who is also invested in getting to know you and personally staying involved with your case can make a huge difference during settlement negotiations (and remember, the overwhelming majority of cases end up with a settlement not a lawsuit). I pride myself on knowing my cases inside and out and the insurance adjusters absolutely pay attention to this. I consider myself to be a skillful negotiator and therefore very few of my cases ultimately end in litigation, although I am not afraid of a lawsuit when the situation calls for it. I am passionate about this approach and work tirelessly to do all I can to negotiate a settlement my client is happy with as most people dread the thought of a lawsuit. If the insurance company is still unwilling to make a fair offer that's when a lawsuit is sometimes necessary.
Absolutely! There could be a number of reasons why that particular attorney or law firm declined your case that have nothing to do with the merits of your case. For example, some law firms will only accept catastrophic injury cases or your case may sound too challenging even if it is righteous. A second opinion from an experienced accident attorney can sometimes provide a whole new perspective or at a minimum provide some peace of mind. I am often willing to take on cases that other attorneys turned down especially when I feel that client really needs my help.
